Term & Conditions

Easy Motorbike Rental Agreement, Waiver of Liability & Release

Please read this Agreement carefully before using Easy Motorbike services. By registering, unlocking, renting, or riding a vehicle, you agree to the terms and conditions below.

Operator

The service is provided by:

Easy Motorbike (KL) Sdn Bhd

The services include:

  1. Rental and use of Easy Motorbike electric vehicles (“Vehicle”)
  2. Related equipment, support, and services provided through the Easy Motorbike App

The App may require your personal information, including your name, contact details, payment information, and account details. Your information will be handled according to Easy Motorbike’s Privacy Policy.

 


 

1. General Rental & Vehicle Use

1.1 Rider Responsibility

The Rider is the person who rents and activates the Vehicle.

The Rider agrees that:

  1. The Vehicle may only be used by the registered Rider.
  2. The Rider is responsible for all use of the Vehicle under their account.
  3. The Rider must follow all terms in this Agreement.
  4. The Rider must not allow another person to use the Vehicle.

 


 

1.2 Age Requirement

The Rider confirms that they are at least 18 years old.


 

1.3 Ability to Operate the Vehicle

The Rider confirms that they:

  1. Understand how to operate the Vehicle.
  2. Are physically fit and capable of riding safely.
  3. Have reviewed the safety information provided by Easy Motorbike.

The Rider is responsible for deciding whether conditions are safe to ride, including:

  1. Rain
  2. Poor visibility
  3. Road conditions
  4. Traffic conditions
  5. Extreme weather

The Rider must adjust their riding speed and behaviour accordingly.

 


 

1.4 Vehicle Ownership

The Vehicle and all related equipment remain the property of Easy Motorbike.

The Rider must not:

  1. Modify, dismantle, repair, or damage the Vehicle.
  2. Remove or change any stickers or markings.
  3. Use the Vehicle for advertising or commercial purposes without approval.

 


 

1.5 Vehicle Availability

Vehicle availability is not guaranteed at all times.

Easy Motorbike may:

  1. Limit the number of available Vehicles.
  2. Require a Rider to return a Vehicle when necessary.

 


 

1.6 Service Area

The Rider must only use the Vehicle within approved service areas.

The Rider must not:

  1. Enter restricted areas.
  2. Move or transport the Vehicle outside approved areas without permission.

 


 

1.7 Following Laws & Regulations

The Rider must follow all applicable laws and regulations relating to:

  1. Traffic
  2. Parking
  3. Riding
  4. Pedestrian safety
  5. Helmet requirements

The Rider must use the service responsibly and consider other road users.

 


 

1.8 Prohibited Use

The Rider must not:

Unsafe riding

  1. Ride under the influence of alcohol, drugs, medication, or any substance that affects riding ability.
  2. Carry another person or child.
  3. Ride recklessly or in a dangerous manner.

Vehicle misuse

  1. Tamper with or attempt to access the Vehicle systems.
  2. Add unauthorised locks.
  3. Damage or misuse the Vehicle.

Restricted parking

The Vehicle must not be parked:

  1. On private property without permission.
  2. In locked or inaccessible areas.
  3. Blocking roads, walkways, entrances, or public access.
  4. In prohibited parking locations.

The Vehicle should be parked:

  1. In a visible location.
  2. Upright using the kickstand.
  3. Away from areas where it may easily fall or be damaged.

 


 

1.9 Vehicle Purpose

The Vehicle is intended for normal transportation use only.

The Rider must not use the Vehicle for:

  1. Racing
  2. Stunts
  3. Off-road riding
  4. Unsafe activities
  5. Illegal activities
  6. Commercial use without approval

 


 

1.10 Weight Limit

The Rider must not exceed the maximum weight limit of the Vehicle.

 


 

1.11 No Tampering

The Rider must not:

  1. Attempt to bypass security systems.
  2. Access restricted parts of the Vehicle.
  3. Use the service outside the intended purpose.

 


 

1.12 Accidents, Damage & Traffic Violations

The Rider must report as soon as possible:

  1. Accidents
  2. Injuries
  3. Vehicle damage
  4. Lost or stolen Vehicles
  5. Traffic violations

If an accident involves injury, property damage, or theft, the Rider must make a police report within 24 hours.

The Rider is responsible for:

  1. Traffic fines
  2. Parking penalties
  3. Recovery charges
  4. Costs caused by misuse, negligence, loss, or theft

Easy Motorbike may cooperate with authorities if information is required.

 


 

1.13 Vehicle Damage Responsibility

The Rider must return the Vehicle in the same condition as received, excluding normal wear and tear.

The Rider may be charged for:

  1. Damage caused during rental.
  2. Theft or loss caused by the Rider.
  3. Vandalism.
  4. Water damage.
  5. Damage to related equipment.

Charges may include repair, replacement, administration, and processing fees.

 


 

1.14 Electric Vehicle Conditions

The Vehicle is an electric vehicle and requires battery power to operate.

The Rider understands that:

  1. Battery level decreases with use.
  2. Speed and performance may reduce when battery is low.
  3. Battery range depends on distance, riding style, weather, and road conditions.
  4. Battery level at the start of a ride is not guaranteed.

The Rider is responsible for checking the battery level before riding.

The Vehicle may stop operating if the battery runs out during the ride.

 


 

1.15 Charging the Vehicle

The Rider must not charge the Vehicle unless instructed or approved by Easy Motorbike.

The Rider is responsible for any damage, injury, loss, or cost caused by unauthorised charging or improper charging.

 


 

1.16 App & Mobile Device Requirements

The Rider needs:

  1. A compatible smartphone.
  2. Active internet connection.
  3. Sufficient phone battery.

The Rider is responsible for any issues caused by:

  1. Poor network connection.
  2. Phone problems.
  3. Battery loss.

Rental charges may continue until the ride is properly ended.

 


 

2. Payments & Fees

2.1 Rental Fees

The Rider agrees to pay:

  1. Rental fees shown in the App.
  2. Applicable taxes or government charges.
  3. Additional fees stated in this Agreement.

Pricing may change from time to time.

If Easy Motorbike pays any fines or charges caused by the Rider’s actions, these costs may be charged back to the Rider together with reasonable administrative fees.

 


 

2.2 Promotional Codes

Promotional codes:

  1. Must only be used according to their terms.
  2. Cannot be sold or transferred.
  3. May be cancelled or expire.
  4. Cannot be exchanged for cash.

Easy Motorbike may remove benefits obtained through misuse or fraudulent activity.

 


 

2.3 Ride Duration & Ending Rental

The Rider must end each ride through the App.

Rental time starts when the Vehicle is unlocked and ends when the App confirms the ride has ended.

If the ride is not ended properly:

  1. Charges will continue.
  2. The Rider remains responsible for the Vehicle.

If there is a technical issue, the Rider must contact Easy Motorbike immediately.

Vehicles not properly returned may be treated as lost or stolen.

 


 

2.4 Payment Method

The Rider must provide a valid payment method.

The Rider authorises Easy Motorbike to charge:

  1. Rental fees.
  2. Additional charges.
  3. Fines.
  4. Damage or recovery costs.

Any disputed charges must be reported within 3 business days with the relevant trip details.

 


 

2.5 Vehicle Recovery Fee

If a Vehicle is left in an unreachable, restricted, or improper location and Easy Motorbike needs to recover it, recovery charges may apply.

 


 

3. Additional Terms of Use

3.1 Safety Check

Before riding, the Rider should check:

  1. Wheels
  2. Brakes
  3. Lights
  4. Vehicle condition
  5. Battery level

Do not ride if the Vehicle appears unsafe.

Report issues immediately.

 


 

3.2 Lost or Stolen Vehicle

A Vehicle may be considered lost or stolen if:

  1. It is not returned within the required period.
  2. It is left in an inaccessible location.
  3. The tracking system is disabled.
  4. There is evidence suggesting theft or misuse.

The Rider may be responsible for:

  1. Vehicle replacement costs.
  2. Recovery costs.
  3. Related fees.

The Rider must report missing Vehicles immediately.

4. Termination of Service

Easy Motorbike may suspend or terminate a Rider’s access to the service if necessary, including for:

  1. Violation of this Agreement.
  2. Misuse of the Vehicle.
  3. Safety concerns.
  4. Fraudulent or unauthorised activities.

The Rider may stop using the service at any time.

Ending the service does not remove any responsibility for:

  1. Outstanding payments.
  2. Damage charges.
  3. Fines.
  4. Other obligations under this Agreement.

 


 

5. Privacy & Personal Information

Easy Motorbike collects and uses Rider information to provide and improve the service.

This may include:

  1. Name
  2. Contact details
  3. Account information
  4. Payment information
  5. Ride information

Personal information will be handled according to Easy Motorbike’s Privacy Policy.

 


 

6. Use of Images and Recordings

By using Easy Motorbike services, the Rider agrees that Easy Motorbike may use photos, videos, or recordings taken during the use of the service for:

  1. Marketing
  2. Promotions
  3. Publicity
  4. Service-related purposes

This includes use on websites, social media, and other promotional materials.

8. Governing Law

This Agreement is governed by the laws of Malaysia.

Any disputes relating to this Agreement will be handled according to Malaysian law.

 


 

9. Liability, Risk & Release

By using Easy Motorbike services, the Rider understands and accepts that riding an electric vehicle involves risks.

These risks may include:

  1. Traffic accidents.
  2. Road conditions.
  3. Potholes or uneven surfaces.
  4. Weather conditions.
  5. Vehicle malfunction.
  6. Actions of other road users.
  7. Rider mistakes or unsafe riding.

The Rider is responsible for operating the Vehicle safely and following all applicable laws.

To the extent allowed by law, Easy Motorbike is not responsible for injuries, damages, losses, fines, or claims resulting from:

  1. Rider misuse.
  2. Failure to follow safety instructions.
  3. Traffic violations.
  4. Unsafe riding.
  5. Failure to properly operate the Vehicle.

This does not apply where the issue is caused by Easy Motorbike’s gross negligence or intentional misconduct.

 


 

10. Rider Responsibility for Claims & Damages

The Rider agrees to be responsible for claims, losses, costs, or damages caused by:

  1. Breaching this Agreement.
  2. Misusing the Vehicle.
  3. Causing damage to property.
  4. Injuring another person.
  5. Violating laws or regulations.

This may include:

  1. Repair costs.
  2. Recovery fees.
  3. Legal costs.
  4. Administrative fees.

 


 

11. Public Road & City Conditions

The Rider understands that Vehicles operate on public roads and areas where conditions may change.

Possible hazards include:

  1. Road defects.
  2. Traffic.
  3. Weather.
  4. Construction.
  5. Unexpected obstacles.

The Rider accepts responsibility for these risks while using the Vehicle.

 


 

Personal Rental Program Addendum

These terms apply to personal or extended rentals (such as weekly or monthly rentals).

12. Personal Rental Responsibility

During the rental period, the Rider is responsible for the Vehicle.

The Rider must:

  1. Keep the Vehicle secure.
  2. Store the Vehicle safely when not in use.
  3. Prevent unauthorised use.
  4. Maintain sufficient battery charge.

The Vehicle cannot be used by other riders during the personal rental period.

The Vehicle must not be used for commercial purposes unless approved.

 


 

13. Personal Rental Availability

Personal rentals may only be available during selected periods.

Easy Motorbike may:

  1. Suspend the program.
  2. Change availability.
  3. End the program when necessary.

 


 

14. Delivery & Return

The Vehicle will be delivered and collected according to Easy Motorbike’s arrangements.

The Rider must return:

  1. The Vehicle.
  2. Keys or locks provided.
  3. Charging equipment or accessories.

The Rider may be charged for:

  1. Late return.
  2. Missing equipment.
  3. Damage beyond normal wear and tear.

 


 

15. Personal Rental Damage & Issues

The Rider must report:

  1. Damage.
  2. Malfunctions.
  3. Safety concerns.

Easy Motorbike may:

  1. Inspect the Vehicle.
  2. Request the Vehicle’s return.
  3. Replace the Vehicle where appropriate.

 


 

16. Personal Rental Charging

For personal rentals, the Rider may be responsible for charging the Vehicle using approved charging equipment.

Do not charge the Vehicle:

  1. If it is wet.
  2. If there is possible water damage.
  3. If the battery or electrical system may be affected.

Any damage, injury, or loss caused by improper charging is the Rider’s responsibility.

 


 

17. Personal Rental Fees

Personal rental fees:

  1. Are based on the pricing shown in the App.
  2. Are non-refundable unless otherwise stated.
  3. Begin from the agreed rental start date.

Charges may continue until the rental is cancelled or ended.

 


 

18. Personal Rental Lost or Stolen Vehicle

A personal rental Vehicle may be considered lost or stolen if:

  1. It is not returned after the rental period.
  2. Easy Motorbike reasonably believes it has been lost or stolen.

The Rider must report any missing Vehicle immediately.

The Rider may be responsible for:

  1. Replacement costs.
  2. Recovery costs.
  3. Related fees.
